Looks like an oxymoron to me. If I get what you say is that although halachically a treifa cannot give birth, the fact today is that they do give birth, so we cannot halachically establish they were treifa before giving birth. (What about if we make an x-ray and see that tarfus before giving birth is that still the case?). Anyway, those who actually gave birth will get that tarfus pass, but why would we assume that they all gave birth if we don't establish that first. Until then we should be bound to the vadai treifos percentage.

They gave birth before, but while producing the milk there is no guarantee that they will give birth again in the future, so they get no pass for the milk they produce now.

I'm sure you can come up with something else to ensure your continuous consumption of milk, without just relying blindly on your Rav.

Still seems to be a מחלוקת אחרונים for example see ערוך השלחן לז but I guess that helps. So it’ll be taluy in all that.

These Halachos are incredibly complex and I am in no position to make my own analysis  on the entirety of the relevant subjects. The indications are that this “problem” existed for hundreds of years and is more of a question of “why” than what. There are lots of teshovos on the subject that I have not gone through as well. Many many Gedolim much more knowledgeable than I were not machmir.
