For those that think this is politics, one of the most political networks (CNN) is saying it is going very well for the defense. Doesn't sound like the correct political stance for them unless it is not about politics.

I'm not sure where you are going with this, but your logic isn't flowing. A man was shot after the shooter alleged his gun barrel was grabbed. We have multiple witnesses who seem to imply this was entirely possible. We have no witnesses saying otherwise. Am I missing something?
I don't know the precise legal standard, but a DA cannot prosecute someone because he thinks they MIGHT be guilty.

I didn't watch the entire case, but to put it mildly, I don't think the judge is happy with the prosecutors antics. The impression I get is the prosecutor like a child who says you didn't tell me I can't use this pen to color the wall, you only told me not to use the other one.
