Has anyone else noticed the lake recently, it's drying up. is this the lowest it's ever been? maybe we'll have to say special teffilos for rain, like in Israel for the Kinneret.  ;)

Now that the Supreme Court declined to take the case, the stay on proceedings is lifted. So Eisemann's lawyers can now continue to bring proof that the prosecutors did a lot worse, like willful Brady, etc...

I'm expecting some action in the coming weeks.

For what purpose? Are they going to sue the prosecution or as part of the defense? If the latter, aren't they awaiting a new trial?

I’m pretty sure they deliberately drain it periodically.

They are trying to get the judge to throw it out entirely, so that the prosecutors cannot move forward with a new trial.

It used to be a a small little channel of water before it was dammed up to make Lake Carasaljo. They allow the lake to drain periodically in the winter to kill the weeds and plant growth.

If that happens, and it's a huge if, I hope they go ahead and sue the prosecution. The immunity shield for prosecutors is extremely high, but I have to imagine that a judge ruling there was an intentional violation gives them a shot at a settlement, which could help with the legal fees. /armchair legal advice from someone without a high school diploma

That depends very much on the exact situation, but it is very clear that the rabbonim would as a practical matter much rather Roe v Wade than the bills advanced by the religious right. You can look in the other threads for further discussion about this and how they are torn between the hashkofos and the practicalities.

I would think it's important to sue the prosecution just so that the message is there so that nobody tries this again. It's infuriating how an innocent man was dragged through this for years. There should be some penalty to an over zealous prosecutor.

Brady Violations are very tough to prove against prosecutors who are given a lot of deference by the judicial system hence they are rarely held accountable.
The SDNY (of particular note former Attn. Preet Bharara) comes to mind as they prosecute high profile cases which give them certain notoriety which = career advancement. These cases (think Shelly Silver and some of the 'corruption' cases which are highly subjective) tax law which you can get anyone on all come down to prosecutorial discretion.
